PICKLEMELON, LLC. DBA "PICKLEMELON SOCIETY" - An Educational Support and Private Social Group Membership Association
Purpose of the Membership Association: PICKLEMELON SOCIETY is an adult educational support and social group and a for-profit private membership organization. Donations collected support organizational and educational expenses and do not entitle the payer to anything other than admission to an event. The mission of this Association is to provide members with a forum to learn, socialize, and explore with confidentiality the swinging, kink, and ENM lifestyle within consenting adult sexual relationships. The PICKLEMELON SOCIETY is not a sex club or a dating club, nor does the PICKLEMELON SOCIETY provide partners for people. Anyone found engaging in or soliciting an act of prostitution, or any kind of pay‐for‐play activities will be expelled without a refund of any donations paid.
By joining PICKLEMELON SOCIETY and/or any website or Social Media Group started by, created by, maintained, or organized by the Association, I agree to the terms and conditions of PICKLEMELON SOCIETY, a Private Membership Association Agreement as follows:
This Association of members declares that our objective is to allow the Private Membership Association founders and all Private Membership Association members a platform in which to conduct all manner of education, all manner of social activity, all manner of lawful assembly, and all manner of private business with the Association and with Association members.
By applying for membership, being a member, and/or attending an event, you represent and warrant the following Terms & Conditions:
1. Representation of Good Faith: I represent that I approach the PICKLEMELON SOCIETY and its affiliated groups, members, and attendees with a sincere desire to learn about and possibly participate in the ENM community it supports, intending no harm, interference, or disruption to the organization or to the lives of any who adhere to its precepts. In consideration of being permitted to attend an event sponsored by the PICKLEMELON SOCIETY, I agree as follows.
2. Protection of Privacy: I agree to respect the privacy of others and I agree to keep confidential the names and activities of others. I recognize that the philosophy of the PICKLEMELON SOCIETY, while legal, is controversial and that activities conducted in pursuance of it are also. I represent that I am not offended by nudity or sexual interaction in my presence in private settings, and I will respect the privacy of all members and attendees, including but not limited to the following: (a) I will not divulge the identity or contact information of anyone as a member of the PICKLEMELON SOCIETY to anyone else without their permission; (b) I will not discuss or disclose any of my experiences in the PICKLEMELON SOCIETY with anyone outside the PICKLEMELON SOCIETY, without the permission of the PICKLEMELON SOCIETY, except that I may discuss my experiences in a way which does not permit the members and attendees to be identified; (c) I will not disclose the location of any place where I have attended any activities of the PICKLEMELON SOCIETY without the consent of the PICKLEMELON SOCIETY. (d) I will not use cameras, tape recorders, cell phones, any recording device, or take photographs at any event sponsored by the PICKLEMELON SOCIETY without the express written permission of the PICKLEMELON SOCIETY. If I record a private conversation of any members and attendees without consent, I shall be subject to liability under the applicable state laws. I understand that if I violate any terms of this agreement, my membership in the PICKLEMELON SOCIETY shall be immediately terminated, and I shall be excluded from attendance at all PICKLEMELON SOCIETY events.
This commitment extends to all forms of information, whether written, verbal, electronic, or otherwise, that is disclosed to me in confidence by any other member. I will refrain from sharing, transmitting, or disclosing any business that happens while at a PICKLEMELON SOCIETY event.
3. Understanding of Obligations, Expectations and Limits: I realize that I am under no obligation to take part in any demonstration or to interact in any scene with other members and attendees. I am aware that BDSM and other kink-related activities may be hazardous. I acknowledge that any participation in these activities is voluntary, and in doing so, I am accepting the responsibility and risks or consequences associated with my choices and actions, including damage to my personal property as well as the property of others or personal injury to myself or others.
I am responsible for clearly communicating my personal preferences, limits, and boundaries to others that I interact with and for enforcing them. I am responsible for ensuring I participate at a level that doesn’t exceed my preferences, personal limits, and boundaries and for removing myself should any activity exceed my limits.
4. Provision as to Alcohol. I understand that as a private event location with a BYOB license under the State Liquor Board of Arizona, if I am of legal drinking age (21), I may bring my own unopened container of wine or beer to PICKLEMELON SOCIETY events. I acknowledge that the PICKLEMELON SOCIETY is not a party facility but a private space that allows its participants to BYOB while they learn and explore. I agree to consume alcohol that I bring responsibly, and I have been encouraged to take a taxi or carpool if I will be drinking alcohol. I assume all risk for my actions while under the influence of alcohol. I understand that if there are any concerns about my ability to operate a motor vehicle upon leaving a PICKLEMELON SOCIETY event, any agent of the event may call the local police department to conduct a wellness check on my behalf, but does not have an obligation to do so. I understand that I cannot remove an open container of alcohol from the premises and must leave open bottles behind for disposal.
5. Provision as to police officers and other government employees: I am not here in any official capacity as a Law Enforcement Officer, Postal Service Agent, or Government Employee. I warrant that, if I am a police officer or government employee of any kind, I am present at any PICKLEMELON SOCIETY event only in my private, individual capacity. I warrant that, if the foregoing statement should prove to be false, I am investigating any of the members and attendees without disclosing my official capacity or purpose and that my presence at any PICKLEMELON SOCIETY event, or those of its affiliates or members and attendees, is an entry into private premises without consent, in violation of the 4th Amendment to the U.S. Constitution and the privacy clause of the State Constitution.
6. Provision as to members of the press: I warrant that, if I am a member of the press, I am present at any PICKLEMELON SOCIETY event only in my private, individual capacity. I warrant that, if the foregoing statement proves to be false, I am here at the direction of my employers and am acting within the scope of my employment; that I am violating the rights of the members and attendees to privacy and may be subject to legal liability.
7. Provision as to Solo Males: Solo Male members must attend a Meet and Greet and complete a formal screening interview before they may attend a private Picklemelon Society event alone. Couples Members may request a Solo Member ticket for an accompanying Solo Male member, but the Solo Male member must remain with their sponsoring Couples Members for the duration of the event, and the Couples Members will be responsible for the conduct of their accompanying Solo Male member. A limited number invites will be sent to Solo Members for a private Picklemelon Society event at the discretion of the Association owners and their designees.
8. Exclusion & Release of Liability- Assumption of Risk: As a condition of your use of facilities at PICKLEMELON SOCIETY events, including, but not limited to, hot tubs, pools, devices, fixtures, buildings for appurtenances, implements and apparatuses, the undersigned assumes all risk of personal injury, death, disease or property loss resulting from any cause whatsoever including, but not limited to contact with natural or man-made objects, patrons, guests, invitees, licensees, employees, agents or its owners due to intentional acts, negligence or breach of contract on the part of the PICKLEMELON SOCIETY, its owners, employees, invitees, agents, licensees and the owner of the facilities.
I agree that the PICKLEMELON SOCIETY, its owners, employees, invitees, agents, licensees, and the owner of the facilities shall not be liable for any such personal injury, death, disease, or property loss due to intentional acts, negligence, or breach of contract. I release the PICKLEMELON SOCIETY, its owners, employees, invitees, agents, licensees, and the owner of the facilities and waive any and all claims.
The PICKLEMELON SOCIETY, its owners, employees, invitees, agents, licensees, and the facility owner are excluded from and released from all liability by the members and attendees.
9. Understanding of Financial Responsibility: As a condition of your use of facilities at PICKLEMELON SOCIETY events, including, but not limited to, hot tubs, pools, devices, fixtures, buildings for appurtenances, implements, and apparatuses, the undersigned acknowledges that they will be held financially responsible for the repair or replacement of any damages as a result of intentional acts, negligence, or inappropriate use of the provided facilities.
10. Duration and limitations: This agreement shall continue in force during my membership with the Association and apply to all PICKLEMELON SOCIETY events and communications between members and attendees. The confidentiality obligation remains in effect during my membership with the Association and even after the termination of my membership.
11. Refund Policy: Membership and event donations are non-refundable. If you do not attend a PICKLEMELON SOCIETY event, your event donation will not be refunded. The PICKLEMELON SOCIETY does not refund unused event donations. All members must manage their PICKLEMELON SOCIETY memberships via their PICKLEMELON website account. This includes taking memberships off of auto-renewal and maintaining valid payments. If you do not attend PICKLEMELON SOCIETY events during your membership period, your membership will not be extended or the expiration date altered, nor will it entitle you to a refund of paid membership donations.
Membership in this Association, “PICKLEMELON SOCIETY,” and any of its groups may be terminated by the Association owners or their designee at any time if they conclude that a member or attendee is acting in a manner contrary to the focus, principles, and betterment of this Association.
I enter this agreement of my own free will without coercion, pressure, or promise. I affirm that within the Association, I am changing my capacity from public person to private member and that as an Association member, I do not represent any Local, County, State, or Federal agency whose purpose is to regulate or to carry out any mission of enforcement, entrapment or investigation and agree to accept membership in the capacity of private members. I have read and understood this document, and all questions have been answered fully to my satisfaction. I understand that I can withdraw from this agreement and terminate my membership in this association at any time and that my membership can and will be revoked if I engage in abusive, violent, menacing, destructive, or harassing behavior towards any other member of The Association.
